The rules for using https://sellhome9.com. Please read carefully โ they include important disclaimers about cash offers and closings.
1. Acceptance of terms
By accessing or using https://sellhome9.com (the "Service") you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service.
2. What we do (and don't do)
SellHome9 is a buyer-side service that makes cash offers to homeowners and connects sellers with cash-buying investor partners. We are not:
- A licensed real-estate brokerage in any state.
- A mortgage lender or mortgage broker.
- An attorney or law firm.
- An escrow company, title company, or settlement agent.
- A financial, legal, or tax advisor.
We do not represent you in negotiations and do not have fiduciary duties to you. Submitting a property does not create a listing agreement, an agency relationship, or a binding contract to buy or sell. You should consult licensed professionals (attorney, accountant, real-estate broker) before signing any purchase contract or deed.
3. Cash offers โ how they work
Cash offers we send are preliminary based on the information you provide and publicly available data. The final purchase agreement may include standard contingencies (clear title, lien payoffs, accurate disclosure of material facts) that, if not met, allow either party to terminate without penalty.
Cash offers are typically lower than what a listed property might sell for on the open market, because the trade-off is speed, no repairs, no commissions, no contingencies, and a guaranteed close. By submitting a property you acknowledge this trade-off and agree that any offer is non-binding until both parties sign a formal purchase agreement.
4. Eligibility
You must be at least 18 years old, the legal owner of the property (or authorized agent of the owner โ e.g., executor, trustee, attorney-in-fact), and capable of entering into a binding contract.
5. Your submissions
When you submit a property you represent that the information is accurate to the best of your knowledge. You understand that materially false information may invalidate any offer. You consent to us pulling public records (county tax records, deed records, lien records) to verify property facts.
6. Acceptable use
You agree not to:
- Submit false or fraudulent information.
- Submit a property you don't own and aren't authorized to sell.
- Use the Service to spam, harass, or defraud other users.
- Scrape, copy, or reuse our content.
- Interfere with the security of the Service.
- Violate fair-housing laws.
7. Communications
By submitting a form you agree we can contact you by email, phone, and SMS as described in our Privacy Policy and SMS Terms & Disclosures.
8. Fees & commissions
The Service is free for sellers. We do not charge listing fees, marketing fees, broker fees, or success fees. We pay typical closing costs (title, escrow, recording) on the deals we close. Your net proceeds are based on the agreed cash price minus any payoffs (mortgages, liens, taxes) you owe on the property.
9. Third-party services
The Service may include links to or integrations with third parties (title companies, attorneys, advertising platforms, mapping services). We are not responsible for third-party content or practices. Your use of those services is governed by their terms.
10. Intellectual property
All content on the Service is owned by SellHome9 or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that any offer will be made, that any offer will be accepted, that any transaction will close, that property valuations will be accurate, or that closings will occur on a particular date.
We do not guarantee specific outcomes โ the actual cash offer for your property depends on condition, location, market, our investor capacity, and other variables. Past performance and case-study results do not guarantee future results.
12. Limitation of liability
To the maximum extent permitted by law, SellHome9 and its officers, directors, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, opportunity, or use, arising out of or related to your use of the Service.
Our aggregate liability for any claim arising out of or related to the Service shall not exceed one hundred U.S. dollars ($100) or the amount you paid us in the twelve months preceding the claim, whichever is greater.
13. Indemnification
You agree to indemnify and hold harmless SellHome9 from any claim, demand, loss, or damage arising out of (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any third-party right (including ownership rights, fair-housing rights, or fraud).
14. Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice. Sections that by their nature should survive termination (disclaimers, limitation of liability, indemnification, dispute resolution) will survive.
15. Governing law & disputes
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws rules. Any dispute shall be brought exclusively in the state or federal courts located in the State of Texas, United States, and you consent to personal jurisdiction there.
16. Changes to these Terms
We may modify these Terms from time to time. Continued use of the Service after changes go into effect constitutes acceptance of the updated Terms.
